Toddler Shot In Lung, PA Dad Charged: DA

A 2-year-old Pottstown boy accidentally shot himself with his father's loaded firearm, leading to felony child and reckless endangerment charges for the father, authorities said.

Luis Marin, 34, of Pottstown, was charged on Thursday, Sept. 26, with endangering the welfare of a child and recklessly endangering another person after leaving the loaded firearm on his bed on Wednesday, May 15, resulting in the child shooting himself, according to the Montgomery County District Attorney's Office.

The toddler was initially transported to Pottstown Hospital but was later transferred to Lehigh Valley Hospital. He was treated for broken ribs, a fractured scapula, and damage to his left lung, according to court documents. A burn mark on the child's skin was also reported, indicating that the firearm was pressed against his skin when the gun was fired.

Marin turned himself over to Pottstown Police on Wednesday, Sept. 25. He was arraigned with bail set at $50,000. His preliminary hearing is scheduled for Tuesday, Oct. 8.

On the day of the shooting, the police were called to the Pottstown Hospital for the report of a toddler with a gunshot wound. The investigation found that just before the shooting occurred, Marin went into the bedroom to get a crossbody bag that held two handguns, which he had removed from the bag and placed on the bed so he could loan the bag to his nephew, the district attorney's office said. 

Marin told police that he was sitting on his bed playing on his phone when he heard the gunfire and then saw his son was shot. He grabbed the toddler and ran outside while applying pressure to the wound. This happened just as the child's mother was arriving home, so they immediately took their son to Pottstown Hospital.
